With the exodus of attorneys from the US Attorney's Offices, and with otherwise very limited resources, we have to be more certain that the government will want to (and have time to) intervene in the cases that we bring to them. It's always been our aim to bring them the best cases. And so we will continue with this approach. The one bright side is the Attorneys General Offices have been the recipients of a lot of the legal talent. This increases an already existing excellent pool of legal talent in the states.

Whistleblowers Alana Stuckmeyer and Anthony Vitello, represented by Schechter and Andrea Fischer, helped expose LiveCare’s fraudulent scheme involving the sale of glucose monitoring and diabetes-related equipment, as well as remote monitoring services, for Medicare patients who may not have had diabetes. This scheme included kickbacks and false Medicare claims, which resulted in substantial financial losses for the government.

The whistleblowers, who worked in LiveCare’s durable medical equipment division, filed a qui tam action in August 2022, alleging violations of Medicare rules. On January 16, 2025, the case was settled with the U.S. government intervening and LiveCare agreeing to pay $4.95 million, without admitting liability. The settlement addresses claims for unnecessary services and illegal kickbacks. Audrey Schechter praised the whistleblowers for their bravery and emphasized the importance of the False Claims Act in protecting taxpayer money. She also commended the work of Assistant U.S. Attorney Sean Keefe for his role in securing the settlement.

This result supports our goals of reducing healthcare fraud that impacts this particularly vulnerable population of our Country.

As we let you know in our prior blog post, the federal government is very interested in bringing COVID19 testing fraudsters to justice. Here's how to find whether you have been victim to this. Check your Medicare statements. The fraudsters obtain your Medicare information illicitly and then they bill Medicare for COVID19 and other tests that they never perform. Often, the "lab" is an out of state store front that actually does not operate as a lab at all. Rather, they are just a fraudulent billing operation. When we examine online reviews for these labs, they typically say "I have never been to X state where this lab is located". The fraudulent labs are banking on the fact that most Medicare beneficiaries do not carefully review their statements, but rather glance at them to confirm that they do not owe any money. As a team, using The False Claims Act, we can discover the scope of the fraud, and blow the whistle on this bad conduct so the government can put a stop to this fraudulent conduct and protect the public fisc.

A couple recent examples of lab fraudsters brought to justice.
